Biography

Kyle Bumgarner is a commercial and employment litigator. He has successfully represented businesses, shareholders, directors, and officers in both federal and state courts on business-related claims including breach of contract, breach of fiduciary duties, fraud, tortious interference with contract, piercing the corporate veil, fraudulent conveyance, and defamation. With this practice, Kyle takes great pride in representing clients through what are most often their most difficult challenges. He understands that jobs, businesses, reputations, and significant sums of money are generally at stake. He is a fierce advocate when necessary, and a creative problem solver when appropriate.

Kyle also regularly litigates and advises on employment issues. He has represented both employees and employers in breach of contract, wrongful termination, harassment, hostile work environment, retaliation, and non-compete matters. His employment experience has taken him before federal and state courts, as well as administrative agencies including the Department of Labor and Equal Employment Opportunities Commission. As well, he regularly advises on Human Resources issues, providing practical solutions to employers as they face the challenges of managing a productive workforce. His employer clients often ask him to conduct seminars for their employees.

Kyle has developed both the skills and substantive knowledge necessary to provide his clients with effective representation. He has led all facets of litigation, from preparing initial pleadings, to developing documentary evidence, taking depositions, drafting and arguing dispositive motions, participating in evidentiary hearings, trying cases, and defending successful judgments at the appellate level.

He earned his undergraduate degree from Centre College, graduating cum laude and being a four-year letterman on the football team. He then graduated first in class from Northern Kentucky University's Chase College of Law, where he served as Managing Editor of the school's law journal. After law school, he had the distinct privilege of serving three terms as law clerk to Judge David Bunning of the United States District Court for the Eastern District of Kentucky. He began his legal career as an associate at Fultz, Maddox, Hovious and Dickens in Louisville, Kentucky, focusing his practice on commercial litigation and healthcare law.

As an Army brat, Kyle never lived anywhere long enough during his childhood to call one place home. His mom often said, "Home is where the Army sends you." Now, though, he is proud to call Bowling Green his home. His wife Kori is a local prosecutor, and together the joy of their lives is raising their son, Bronson.
